These Terms govern purchases of grooming products (“Products”) from PlushPuppy Malaysia via plushpuppy.com.my, purchase orders, or authorised sales channels. By placing an order, you agree to these Terms. For consumers, your statutory rights under the Consumer Protection Act 1999 remain unaffected.
1) Definitions
- We/Us/Our: The Artelier Haus
- You/Your: the purchaser (retail consumer or approved stockist/wholesaler)
- Site: plushpuppy.com.my
- Working Day: Monday–Friday, excluding Malaysian public holidays
2) Scope & Eligibility
We supply grooming Products for dogs and companion animals.
- Wholesale/Stockist: supply is limited to approved accounts. We may accept, suspend, or terminate accounts at our discretion.
- Consumer: if you buy for personal use, rights under the Consumer Protection Act 1999 apply and cannot be excluded.
3) Orders & Acceptance
Your order is an offer to buy. We accept when we (i) email confirmation or (ii) dispatch the Products, whichever occurs first. We may decline or cancel (e.g., stock unavailable, pricing/description errors, suspected fraud). If payment was taken, we’ll refund the affected portion.
4) Pricing, Currency & Taxes
- Prices are in MYR (RM) and may change without notice.
- Unless stated, prices are exclusive of SST and shipping. Applicable taxes and delivery charges appear at checkout or on your invoice.
- Errors & omissions: If a price/description error occurs, we may cancel and refund, or allow you to proceed at the correct price.
5) Payment Terms
- Retail: full payment at checkout (FPX/online banking/card/e-wallet where available).
- Wholesale: default prepayment unless credit terms are approved in writing (e.g., 30 days EOM). Late balances may incur 1.5% per month (or legal maximum) and suspension of supply.
- Title remains with us until full, cleared payment (see §9).
6) Delivery, Risk & Delays
We ship within Malaysia (Peninsular & East Malaysia). Transit times are estimates. Risk of loss passes on delivery to your address or collection by your carrier; title passes on full payment (§9). We are not liable for delays outside our control (courier issues, customs, extreme weather, force majeure).
7) Inspection on Delivery
Inspect on receipt. For damage, shortages or wrong items, notify us within 3 Working Days with photos and your order/invoice number. We may repair, replace, credit, or refund at our discretion.
8) Returns & Exchanges
Retail (Consumers)
- Change-of-mind: unopened/unused items in original condition may be returned within 14 days of delivery (you cover return shipping).
- Hygiene-sensitive items (opened liquids, used tools) are not returnable unless faulty.
- Faulty/incorrect items: contact us within 3 Working Days; we’ll replace or refund.
Wholesale/Stockists
- Returns accepted only for picking errors, transit damage reported within 3 Working Days, or verified defects.
- Requires prior RMA approval. Non-defective returns, special orders, and clearance items are not returnable.
9) Title & Retention of Title (Wholesale)
Title transfers only after full cleared payment. Until paid, you will store Products separately, keep them identifiable, not obscure labels, and permit us to reclaim unpaid goods upon demand.
10) Product Use & Professional Responsibility
- Read labels and follow directions. External use on animals only.
- Not a substitute for veterinary care. If irritation occurs, discontinue and consult a vet.
- Professional groomers/stockists are responsible for appropriate selection and safe application.
11) Warranty & Limitation of Liability
- Products conform to description and are free from material defects within shelf life when used/stored as directed.
- Our total liability is limited to the price paid for affected Products.
- We are not liable for indirect/consequential losses (loss of profits, goodwill, business interruption), except where prohibited by law.
- Nothing limits liability for death/personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under Malaysian law.
12) Wholesale / Stockist Terms (if applicable)
- Resale territory: Malaysia only, unless we authorise export in writing.
- Brand presentation: use current brand guidelines; no veterinary/therapeutic claims.
- Online sales: listing on marketplaces (e.g., Shopee/Lazada) requires prior written consent.
- MAP/advertised pricing: where permitted, adhere to our published guidelines (if provided).
- Promotional assets: non-exclusive, revocable licence to use approved images/copy for genuine Products.
13) Recalls & Safety Notices
You agree to cooperate with any recall, withdrawal, or safety action we or the brand owner initiate, including contacting your customers and removing affected stock.
14) Intellectual Property
“Plush Puppy” and associated marks, names, images, packaging, and content are trademarks/copyrights of their respective owners. No rights are granted beyond what is necessary to market and sell genuine Products.
15) Data & Privacy (PDPA)
We process personal data in accordance with the Personal Data Protection Act 2010 (PDPA) and our Privacy Policy. For wholesale accounts, you consent to us storing business contact details and trade references for account and credit control.
16) Force Majeure
We are not liable for failure or delay caused by events beyond reasonable control (natural disasters, pandemics, strikes, transport failures, government actions). We will resume performance as soon as practicable.
17) Anti-Bribery & Compliance
You will comply with all applicable laws and maintain policies to prevent bribery, corruption, and money laundering.
18) Governing Law & Dispute Resolution
- These Terms are governed by the laws of Malaysia.
- Parties submit to the exclusive jurisdiction of the courts of Malaysia (Kuala Lumpur).
- Optional: Disputes may first go to mediation; unresolved matters may be referred to arbitration at AIAC, Kuala Lumpur by mutual agreement.
19) Changes to Terms
We may update these Terms at any time by posting the revised version on the Site. The version in force at the time of your order applies to that order.
